New laws are created under common law and the decisions are made by judges. Rulings made in previous cases play a big factor in this process; judges hear cases and use the previous rulings to make new laws. If by chance there is no previous ruling what the judge decides becomes law. Common law is mainly why lawyers study previous cases for.

Statutory law is laws made by governments of countries, in our case the legislation. These statues that are passed by the federal congress and state legislation are laws that are formed to meet citizens' needs, to formalize existing laws or resolve an issue that is referred to the government. Our government has a clear role in determining the laws and punishments for its citizens.

The difference between the two laws is; common law is made by judges and statutory law is made by government agency. Common laws are developed every day; there are no fractionalizations on society or caused expenses on the state. Statutory law are organized and codified into law code, these codes are regulated to statutory law exclusively as well as those area where common law is not applicable.
