Abstract

  Bill of Rights this is important to our constitution of the U.S it was produced to making sure the basic human rights wasn’t violated. There were only 10 Amendments with the Constitution at the beginning. Years later that was attached to the Constitution was another 17 Amendments. There was a lot of Amendments along with the Bill of Rights that continued to show crucial part with the Criminal Justice. Amendments that I will discuss in this essay will be the 4th, 5th, 6th and 8th Amendments. All these Amendments are put together for every citizen to be treated reasonable even if the individual is a suspect and is arrested for doing the crimes. In my essay I will be giving an overview of rights that consist of the Bill of Rights 4th, 5th, 6th, and 8th Amendments that is relevant to criminal defenders. I will discuss the 4th Amendment right that affected the procedures implemented in the law enforcement, courts or the correctional facilities, and if I disagree or agree about the way the rights has implemental in criminal justices.

  Fourth Amendment is protection from unreasonable of Search and Seizure. Law Enforcement cannot go into your home and take things unless they have a warrant that states what they are searching for. Police officers cannot search your vehicle unless you give them the permission to do so even if the police officers have a probable cause because you do have the right to not let them search your vehicle. If they have a warrant from the judge the police officers can enter any suspect’s property to search for evidence.

  Fifth Amendment is Due Process, Self- Incrimination and double jeopardy. The Miranda Rights states you have the right to remain silence, anything you say can be used against you in the court of law. The reason this statement must be said is because you have the right to not confess and incriminate yourself for the crime even though you did do it.

  Sixth Amendment is one of the specific rights because it is affected procedures in the Law Enforcement, courts, and the correction facilities. The 6th Amendment that states the accused does have a right to be represented and a speedy trial. Reasons for this is accused would get the help from the state if they do not have an attorney then the courts will appoint them one. With the courts doing this it cost the state money and the longer with the proceedings the state would have to pay more. If the accused gets to go free they can commit even more crimes and be dangerous to the public. Court process if more time would go by the witnesses may suffer from memory loss or perhaps even death.
